Terms and Conditions

By registering for, observing, or participating in any dance classes, workshops, events, or camps with Amongst Queens (operated by Get Amongst It Now Pty Ltd), you ("Student") agree to the following legally binding Terms and Conditions.

For the purposes of these Terms, "Student" includes any individual attending, participating in, observing, or engaging with Company activities, whether on a casual, trial, drop-in, or enrolled basis.

1. Waiver and Assumption of Risk

1.1. The Student acknowledges that dance and physical activities involve inherent risks, including the risk of injury, and voluntarily assumes all risks associated with participation.

1.2. The Student confirms they are medically and physically fit to participate and waives any claims of liability against the coaches, facilitators, or the business for injuries incurred.

1.3. Participation is undertaken entirely at the Student’s own risk.

2. Cancellations, Refunds, and Transfers

2.1. Refunds are available only with a minimum of 38 days' notice prior to the start of the program. A 15% administration and transaction fee applies.

2.2. Cancellations within 7 days of program commencement are non-refundable, except under exceptional, documented circumstances (subject to management approval).

2.3. If the Company reschedules or cancels an event, Students may choose either a full refund or a credit toward future events.

3. Intellectual Property Rights

3.1. All original materials, choreography, class structures, formats, themes (including but not limited to "High Heels Dance Camp," "Sensual Floor-play Dance Camp," "Classy Chair Play Camp," and "Sexy Chair-play Camp"), music arrangements, routines, instructional content, teaching methodologies, and branding elements are the sole and exclusive intellectual property of Nicole Lilyan Fletcher and Get Amongst It Now Pty Ltd ("Company IP").

3.2. Students are strictly prohibited from:

• Copying, reproducing, or recreating any Company IP.

• Teaching, facilitating, or selling classes, camps, or events based on Company IP.

• Using Company IP for marketing, commercial gain, or personal branding outside of official Amongst Queens services.

3.3. Company IP is protected under Australian and global intellectual property laws.

3.4. All media, videos, class recordings, and photos taken during Company services are the property of the Company. Students grant the Company a worldwide, royalty-free, perpetual license to use such media for marketing, promotional, and commercial purposes.

4. Non-Compete Clause

4.1. The Student agrees not to operate, teach, manage, assist, or facilitate any competing dance-based business, class, or offering (including but not limited to high heels dance, chair dance, or floorwork) within:

• Thirty (30) kilometres of any current or future operating location of Amongst Queens; or

• Any geographic area, including online platforms, where the Company operates or markets its services,

for a period of twelve (12) months after:

• Completion of their last class, camp, or event with the Company; or

• Their last date of attendance at any Company service, whichever is later.

4.2. This restriction includes:

• Contacting or soliciting any Amongst Queens students, clients, or audiences.

• Using knowledge gained through Amongst Queens services to run competing or derivative programs.

4.3. Breach of this clause entitles the Company to seek injunctive relief, damages, and recovery of all associated legal and enforcement costs.

5. Confidentiality

5.1. Students agree to maintain confidentiality regarding any internal processes, documentation, trade secrets, marketing strategies, and proprietary methods revealed through participation in Company services.

6. Media Release

6.1. The Student consents to being photographed and filmed during Company events and grants the Company the right to use their image, likeness, name, and testimonials in promotional materials, online platforms, and social media.

6.2. Any content created during participation (including videos, group photos, and performance snippets) becomes joint intellectual property with unrestricted commercial usage rights by the Company.

7. General

7.1. These Terms are governed by the laws of the State of Western Australia and applicable Australian and international laws.

7.2. If any provision is found invalid or unenforceable, the remaining provisions shall remain fully effective.

7.3. Payment for participation constitutes full acceptance of these Terms.

7.4. Where a Student signs or enrols on behalf of a business, company, or other entity, the individual signing personally guarantees compliance with these Terms and Conditions and accepts joint and several liability.

8. Merchandise & Brand Integration – Her Heel

8.1. Her Heel is a registered sub-brand of Get Amongst It Now Pty Ltd, operating alongside Amongst Queens. It involves the sale of dance-related merchandise including high heels, knee pads, leg warmers, and performance apparel.

8.2. All product designs, bundling models (e.g., merchandise packaged with events), marketing materials, and branding related to Her Heel are exclusive to Get Amongst It Now Pty Ltd.

8.3. Participation in classes or events involving Her Heel products does not grant Students the right to recreate, replicate, or sell similar merchandise or business models.

8.4. Students and third parties are strictly prohibited from:

• Developing or selling products similar to Her Heel.

• Copying or adapting the bundling and sales formats.

• Using any Her Heel branding, content, or designs for commercial gain.

8.5. Any unauthorised replication or misuse of Her Heel intellectual property will result in legal action, including claims for injunctive relief and damages.

9. Brand Ambassadors, Collaborators, and Affiliates

9.1. Amongst Queens and Her Heel may engage students, performers, and third-party collaborators as ambassadors, models, or content creators.

9.2. All media created by, with, or featuring ambassadors or affiliates remains the exclusive property of Get Amongst It Now Pty Ltd and may be used indefinitely for promotional and commercial purposes.

9.3. Affiliates and collaborators must operate under signed agreements and are not permitted to promote competing services or products without prior written consent from the Company.

10. Non-Solicitation Clause

10.1. The Student agrees that for a period of five (5) years following their final class, camp, or event with the Company (or their last date of attendance, whichever is later), they will not, directly or indirectly:

• Solicit, approach, entice, hire, or attempt to solicit any current or former students, clients, collaborators, contractors, suppliers, sponsors, partners, or affiliates of Amongst Queens or Her Heel; or

• Engage in any activity that could divert business, opportunities, or goodwill from Amongst Queens or Her Heel.

10.2. This restriction applies for the benefit of both Amongst Queens and Her Heel and their successors, assigns, and related entities.

10.3. Breach of this non-solicitation clause entitles the Company to seek immediate injunctive relief, damages, and recovery of all associated legal fees and costs.

Additional Enforcement Clause: Legal Costs

In the event of any breach of these Terms and Conditions, the Student agrees to pay all legal fees, costs, and disbursements incurred by Get Amongst It Now Pty Ltd or its associated entities in enforcing its rights, on a full indemnity basis.
